Introduction

These Terms and Conditions (the "Terms") govern your use of the 26retrorevive website (the "Site") and all purchases of products from us.

This website is operated by 26retrorevive, an independent apparel brand based in Coimbra, Portugal. Our collections are inspired by the heritage and aesthetics of classic cycling, and we ship our products internationally.

Acceptance of Terms

By accessing or using any part of this Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. This agreement also incorporates by reference our Privacy Policy and our Returns and Refund Policy.

If you do not agree to all the terms and conditions of this agreement, you must not use the website or purchase our products.

Products and Services

We offer a range of apparel, including t-shirts, hoodies, and sweatshirts, which feature original artwork paying tribute to vintage cycling culture. Our items are produced to order in small runs to maintain a high standard of quality. Please note that products are sold as described and are not subject to customer customisation.

We make every reasonable effort to display the colours, textures, and details of our products as accurately as possible. However, we cannot guarantee that your computer monitor's or device's display will be completely accurate. Variations may occur due to screen settings and the inherent tolerances of textiles. Similarly, garment measurements provided on our product pages are approximate and include a reasonable tolerance of approximately ±2 cm.

Fabric composition, weight, and care instructions are provided for each item. We reserve the right to limit quantities, discontinue products, or update specifications at any time without prior notice.

Pricing and Payments

All prices are displayed in Euros (EUR) unless explicitly stated otherwise. For orders within the European Union, prices are inclusive of VAT where applicable under Portuguese law.

Orders delivered to destinations outside the European Union may be subject to import duties, customs taxes, or other brokerage fees upon arrival in the destination country. These additional charges are the sole responsibility of the recipient and are not controlled or collected by 26retrorevive.

We utilise reputable third-party payment providers to ensure all transactions are processed securely. The accepted payment methods are those displayed at the checkout stage. While we strive for complete accuracy, pricing or availability errors may occasionally occur. If we discover an error that affects an order you have placed, we will contact you promptly with the correct information. You will then have the option to accept the revised order or cancel it for a full refund.

A sales contract between you and 26retrorevive is formed only when we dispatch your order and send a corresponding dispatch confirmation email.

Shipping and Delivery

Orders are typically prepared and packed within one to three business days from the date of purchase. Business days are Monday to Friday and exclude public holidays in Portugal. We ship all orders from Portugal using CTT Expresso. Once your order has been dispatched, you will receive an email confirmation containing a CTT Expresso tracking code, allowing you to monitor your parcel's journey.

We provide estimated delivery times for your convenience. These are realistic estimates based on carrier information but are not guaranteed. Transit times may be affected by carrier workload, customs procedures, or other events beyond our reasonable control.

• Typical transit times are one to three business days for Portugal and Spain.

• Typical transit times are four to seven business days for the rest of Europe.

Shipping costs are calculated and displayed at checkout. Currently, shipping is €2.95 for Portugal and Spain, and €3.45 for the rest of Europe. We offer free standard shipping on orders over €60; this threshold is calculated after any discounts and before applicable taxes.

It is your responsibility to ensure that the delivery address and contact details provided are complete and accurate. If a parcel is returned to us due to an incorrect or incomplete address, we will contact you. We can reship the parcel at your expense, or alternatively, refund the product price (less the original shipping cost) once the parcel is received back by us in good condition. The risk for the products passes to you upon confirmed delivery at the address you provided.

Returns and Exchanges

If you wish to return an item because you have changed your mind, you may do so within fourteen (14) calendar days from the date you received your order. To initiate a return, please email us at suporte@26retrorevive.com with your order number and the item(s) you wish to return. We will reply with simple instructions. You must send the goods back to us within fourteen (14) days of notifying us of your intent to return. You are responsible for the cost of return postage and for the parcel until it safely reaches us. We strongly recommend using a tracked shipping service.

All returned items must be in their original, saleable condition: unused, unwashed, and with all original tags and packaging intact. Once we receive and inspect your return, we will process a refund to your original payment method. Please be aware that your bank or payment provider may take several business days to credit the funds to your account.

We do not offer direct exchanges at this time. If you require a different size or style, please return the original item for a refund and place a new order.

EU/EEA Consumer Right of Withdrawal

If you are a consumer based in the European Union or European Economic Area, you have a legal right to withdraw from your purchase within fourteen (14) calendar days of receiving your order, without giving any reason. If you exercise this right, we will refund the product price and the cost of the standard outbound shipping (if paid) within fourteen (14) days of our receipt of the returned goods or of receiving proof of their return. We reserve the right to make a deduction from the refund for any diminished value of the goods caused by handling them beyond what is necessary to establish their nature, characteristics, and functioning.

Damaged, Defective or Incorrect Items

If your order arrives damaged, defective, or incorrect, please contact us at suporte@26retrorevive.com within seven (7) days of delivery. Please include photographs of the issue. Where an issue is confirmed, we will provide a suitable remedy, such as a repair, replacement, or full refund, and will cover any reasonable costs associated with returning the item.

Intellectual Property

All content present on this website, including but not limited to designs, graphics, photographs, text, logos, trademarks, and other materials, is the property of 26retrorevive or is used under licence. This content is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, adapt, or otherwise use any of this material without our prior written consent.

Our original designs are created to honour the visual culture and heritage of classic cycling. They do not claim or imply any affiliation, endorsement, or sponsorship by any current or historical bicycle manufacturer, team, or brand. If you believe your intellectual property has been used in error, please contact us at support@26retrorevive.com so we may review the matter promptly.

User Responsibilities

You agree to use this website only for lawful and responsible purposes. By placing an order, you agree to provide current, complete, and accurate information at checkout and to keep your account details (if any) secure. You must not misuse the Site, interfere with its operation, attempt unauthorised access, or engage in any activity that is fraudulent, deceptive, or infringes upon the rights of others.

Products purchased are intended for personal use. Any commercial resale or wholesale activity requires our explicit written permission.

Limitation of Liability

Nothing in these Terms shall be construed as excluding or limiting our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot be excluded or limited under applicable law.

Subject to the foregoing, we shall not be liable for any indirect, incidental, or consequential losses, nor for any loss of profits, revenue, data, or goodwill. Our total aggregate liability in respect of any claim arising out of or in connection with an order shall not exceed the total amount paid for that specific order.

We are not responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events beyond our reasonable control (a "Force Majeure Event"), including but not limited to carrier disruption, customs delays, strikes, or natural events.

Privacy and Data Protection

We are committed to protecting your privacy. We process all personal data in accordance with our separate Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

Governing Law and Jurisdiction

If you reside within the European Union or European Economic Area and we sell to your country of residence, the mandatory consumer protection laws of your country will apply alongside these Terms.

Subject to those protections, these Terms and any disputes or claims arising out of them are governed by and construed in accordance with the laws of Portugal. You agree to submit to the non-exclusive jurisdiction of the competent courts of Coimbra, Portugal, to resolve any dispute.

For consumers residing in the EU, the European Online Dispute Resolution (ODR) platform is available for resolving disputes. In Portugal, consumers may also seek assistance from the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC).

Amendments to the Terms

We reserve the right to update or modify these Terms from time to time to reflect changes in our business operations, services, or in applicable law. The version published on this page, identified by the "Last updated" date at the top, is the one currently in force.
